Data Processing Agreement (DPA)
This Data Processing Agreement ("DPA") forms part of the Terms of Service and applies to the processing of personal data by ASKIABOT LIMITED.
1. Parties
Data Processor: ASKIABOT LIMITED, 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom
Data Controller: The customer using the AskiaBot platform.
2. Subject Matter
This DPA governs the processing of personal data uploaded by the Customer to the AskiaBot platform for the purpose of providing AI assistant services.
3. Duration
Processing will occur for the duration of the service agreement unless otherwise required by law.
4. Nature & Purpose of Processing
- Hosting and processing user-provided content
- Generating AI responses based on customer data
- Analytics and service improvement
5. Categories of Data Subjects
- Customer employees
- Website visitors
- End-users interacting with AI assistants
6. Types of Personal Data
- Identification data
- Professional information
- Content data uploaded by the customer
- Interaction data
7. Obligations of the Processor (ASKIABOT LIMITED)
ASKIABOT LIMITED shall:
- Process data only on documented instructions from the Customer
- Ensure confidentiality of personnel
- Implement appropriate security measures
- Assist the Customer in fulfilling data subject rights
- Notify the Customer of data breaches without undue delay
8. Subprocessors
ASKIABOT LIMITED may engage subprocessors to provide the service. A list of subprocessors may be provided upon request. ASKIABOT LIMITED remains fully liable for subprocessors' compliance.
9. Data Security Measures
- Encryption at rest and in transit
- Access controls
- Infrastructure monitoring
- Regular security updates
10. Data Breach Management
In the event of a personal data breach, ASKIABOT LIMITED will notify the Customer promptly and provide relevant details.
11. Data Deletion or Return
Upon termination of the service, personal data will be deleted or returned at the Customer's request, unless retention is required by law.
12. Audits
Upon reasonable request, ASKIABOT LIMITED will provide information necessary to demonstrate compliance with this DPA.
13. Governing Law
This DPA is governed by the laws of England and Wales.
